Chan, Moon Yee Lau and Shang Ching Huang, prevailed in an appeal of the State Supreme Court's decision denying their motion for spoliation sanctions against a defendant in a defamation and tortious interference case. The Appellate Division, First Department unanimously modified the lower court's order denying sanctions and held that the appropriate sanction was to strike Defendant's answer.
